Judge refuses to dismiss law enforcement officers from false-detention lawsuit

A federal judge in Richmond, Va., has refused to dismiss from a lawsuit several FBI and Secret Service agents as well as local police officers who arrested a military veteran based on an opinion from a counselor who had never met him that he might be a danger.

The officers had confronted the veteran, Brandon Raub, after he expressed criticism of the U.S. government on a social networking page.

They arrested Raub and kept him in custody for an evaluation based on the long-distance opinion from Michael Campbell, a psychotherapist hired by the local county. But when the case came before a judge, his ruling found the concerns raised by the officers were “so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy.”

Raub then sued the officers for taking him into custody.
The latest ruling rejected a request by the officers to end the case.

“Brandon Raub’s case exposes the seedy underbelly of a governmental system that continues to target military veterans for expressing their discontent over America’s rapid transition to a police state,” said John W. Whitehead, president of The Rutherford Institute.

“While such targeting of veterans and dissidents is problematic enough, for any government official to suggest that they shouldn’t be held accountable for violating a citizen’s rights on the grounds that they were unaware of the Constitution’s prohibitions makes a mockery of our so-called system of representative government. Thankfully, Judge Hudson has recognized this imbalance and ensured that Brandon Raub will get his day in court,” he said.

The decision came from U.S. District Judge Henry Hudson, who essentially said there is not enough information at this point in the case to dismiss the law enforcement defendants. He ordered limited discovery.

The Rutherford Institute called the decision a victory for free speech and the right to be free from wrongful arrest.

Raub, a decorated Marine, had been taken into custody by “a swarm” of FBI, Secret Service agents and local police and forcibly detained in a psychiatric ward for a week because of controversial song lyrics and political views posted on his Facebook page, Rutherford reported.

Hudson said the Rutherford Institute, which is representing Raub, had alleged sufficient facts to indicate that the involuntary commitment violated his rights under the U.S. Constitution’s First and Fourth Amendments.

Institute attorneys had filed the civil rights lawsuit in federal court on behalf of Raub, alleging that his seizure and detention were the result of a federal government program code-named “Operation Vigilant Eagle” that involves the systematic surveillance of military veterans who express views critical of the government.

The complaint alleges that the attempt to label Raub as “mentally ill” and his subsequent involuntary commitment was a pretext designed to silence speech critical of the government.

It was Aug. 16, 2012, when Chesterfield police, Secret Service and FBI agents arrived at Raub’s home, asking to speak with him about his Facebook posts. Like many Facebook users, Raub, a Marine who has served tours in Iraq and Afghanistan, uses his Facebook page to post song lyrics and air his political opinions.

Without providing any explanation, levying any charges against Raub or reading him his rights, law enforcement officials handcuffed Raub and transported him to police headquarters, then to John Randolph Medical Center, where he was held against his will.

The Institute reported in a hearing on Aug. 20, government officials pointed to Raub’s Facebook posts as the reason for his incarceration. While Raub stated that the Facebook posts were being read out of context, a special justice ordered Raub be held up to 30 more days for psychological evaluation and treatment.

But Circuit Court Judge Allan Sharrett ordered Raub’s immediate release a short time later, and the lawsuit was initiated.

Leftists have put a bull's-eye on Sherriff Arpaio's back because he created a Cold Case Posse lead by investigator Mike Zullo. This posse conducted thousands of hours of work and concluded that the document presented to the American public in April 2011 as Obama's birth certificate is undoubtedly fraudulent.
CPFER has hired Larry Klayman, Esq., the founder of Judicial Watch and Freedom Watch but Klayman will be appearing in his private capacity in this case. According to CPFER and Klayman, Arpaio is being subjected to an illegal and unconstitutional recall effort in a politically if not criminally motivated attempt to harass and prevent Arpaio from carrying out his duties as the chief law-enforcement officer of Maricopa County.
Since Arpaio was only recently reelected to a sixth term on November 6, 2012, Respect Arizona’s petition is not only untimely but fails to set forth any valid grounds for a recall so soon after this election.

"If Respect Arizona’s illegal recall effort were to become the norm, then all public officials in the state could be recalled without cause, thus severely harming the electoral system. Even judges could be subject to this sort of harassment. Shipper warns move 'has potential to threaten privacy of all customers'

The Obama administration is demanding the nation’s two biggest shipping companies police the contents of Americans’ sealed packages, and a FedEx spokesman is warning that the move “has the potential to threaten the privacy of all customers that send or receive packages.”

FedEx and UPS are in the Justice Department’s cross-hairs for not flagging shipments of illegally prescribed drugs the companies say they had no way of knowing were in their possession.

 Criminal charges could be coming against the carriers, even though the government has not alleged any deliberate wrongdoing by the companies.

FedEx spokesman Patrick Fitzgerald said his company has a 40-year history of actively assisting the government crackdown on any criminal conduct, but he told WND this probe was very different from the start.

“What is unusual and really disturbing is it became clear to us along the way that FedEx was being targeted for some level criminal activity as it relates to these medicines that are being shipped from pharmacies, and we find it to be completely absurd because it’s really not our role,” Fitzgerald said. “We have no way of knowing what is legal and not within the packages that we’re picking up and delivering in this situation.”

“At the heart of the investigation are sealed packages that are being sent by, as far as we can tell, licensed pharmacies. These are medicines with legal prescriptions written by licensed physicians. So it’s difficult for us to understand where we would have some role in this. We are a transportation company that picks up and delivers close to 10 million packages every day.

They are sealed packages, so we have no way of knowing specifically what’s inside and we have no interest in violating the privacy rights of our customers,” Fitzgerald said.
In addition to the unrealistic expectation that the federal government seems to have for the companies to know what’s in every package, Fitzgerald said protecting the rights of customers is paramount and the issues go hand-in-hand.

“They clearly are attempting to put some responsibility for the legality of the contents of these packages. That’s why for us it goes far beyond even just the online pharmacy situation. This really has a chilling effect. It has the potential to threaten the privacy of all customers that send or receive packages via FedEx because the government is assigning a role on us as law enforcement or taking on their role in a way that is not appropriate,” Fitzgerald said.
FedEx sought to diffuse the standoff by offering to stop doing business with any pharmacies that the government suspected to be involved in illegal activities. The Justice Department declined, citing the potential for the pharmacies to sue over a lack of due process.

“If the government were to come to us and give us the name of a customer that’s engaged in some level of illegal activity, we can immediately stop shipping for that customer. We will not tolerate any illegal activity within our networks,” Fitzgerald said. “What we want here is a solution that will apply for the entire industry and serve the public’s interest. That’s why we find it completely absurd and, to a large degree, stunning that the government is not working with us on that solution as they have with other problems in the past. As long as they’re not doing that, there’s really no solution even if they were to pursue an investigation or criminal charges against a specific company. There needs to be an industry-wide solution that will put a stop to this problem.”

That leaves FedEx and UPS with the task of stopping illegal shipments from sources the government will not divulge.

“The comparison that we’ve made is a no-fly list. It’s as if the government were to go to major commercial airlines and accuse them of some level of criminal activity if they were to allow somebody on the no-fly list onto one of their planes without providing them a no-fly list,” Fitzgerald said. “What we want here is the no-fly list for online pharmacies. If they are aware of some level of illegal activity by some number of pharmacies, simply provide us that list and we will stop providing service. It’s a very simple solution.”

Fitzpatrick said no other private carriers are being targeted by the Justice Department, and he has no evidence to suggest this probe is designed to boost the financially strapped U.S. Postal Service at the expense of private competitors.

UPS is currently negotiating a settlement with the government, but FedEx is fighting this all the way.

“Settlement is not an option for us when there’s no illegal activity on our part,” Fitzpatrick said.

WASHINGTON – Russian President Vladimir Putin no longer wants just to reform the Russian military. He wants boost its capabilities, according to report from Joseph Farah’s G2 Bulletin.

This means that he and his Army General Staff chief, Gen. Valeryi Gerasimov, will be looking to ways to achieve advances in Russian military performance levels.

This new perspective is due to the uncertainties arising from the Arab Spring and the military’s experiences in the 2008 Russian invasion of Georgia.

Gerasimov believes that the distinction between war and peace have blurred, given recent events in the Middle East and North Africa. The Arab Spring has brought about foreign intervention, chaos, humanitarian disasters and civil war, Gerasimov has pointed out.

In a recent speech, Gerasimov said that experiences stemming from the Arab Spring don’t constitute war in the traditional sense but the unrest and chaos that ensues could become the “typical war” of this century.

He said that this type of conflict creates devastating social, economic and political results that, in effect, equate to a war.

The event, called a coronal mass ejection, or CME, while not occurring as frequently as solar flares, is still a common phenomenon. This time, however, rather than projecting out into space, it’s headed straight for Earth.

Given the direction and speed of the CME, Science World Report explains, mild to moderate effects may be felt as soon as Sunday.

When a CME strikes the Earth, the traveling body of solar energetic particles can – on rare occasion – causes a significant enough geomagnetic storm to disrupt the Earth’s magnetosphere. Results may include stronger aurora around the Earth’s magnetic poles, disruption of radio transmissions and even damage to satellites and electrical transmission facilities, which could cause power outages.

The U.S. Army, Air Force and Marine Corps have now halted their tuition assistance programs after across-the-board federal spending cuts went into effect March 1. The suspension applies to all components, including Reserve and National Guard personnel on active-duty orders. The U.S. Navy is also expected to deliver a similar announcement soon. The cuts do not affect G.I. Bill benefits.

According to new reports, any new applications for tuition assistance will be rejected by the Air Force. The branch’s application site states, “Air Force Military Tuition Assistance Currently not Available.”

If ratified, the Trans-Pacific Partnership will:

• Surrender U.S. sovereignty to an international tribunal with authority higher than the U.S. Supreme Court;

• Give up 544 million acres of public land, one-quarter of the entire U.S. land area, to UN and World Bank judges who will decide how our lands are used; and

• Ban “Buy American” policies.
