"Stonewalling" Lisbon Taxpayers For The Truth To Simple Questions, Business As Usual !

                                        I APOLOGIZE!!!!

I apologize to the residents of Lisbon because there is no way I can keep my word pertaining to the “Unfavorable Expenditure”.  I asked the Town Council at the last council meeting and did not receive an answer as to what this “Unfavorable Expenditure” was used for. 

So, on November 22, 2013, I submitted the following Freedom of Access Act (FOAA) “Respectfully request a copy of the Purchase Order for the “Unfavorable Expenditure” identified in the yearly Auditor’s report.”  


Next, I received an email from the Town Clerk reference FOAA # 152 stating and I quote “The Finance Director indicated that she does not have enough information to determine what you are referencing?  Therefore, she is unable to provide any further information.”  On November 22, 2013, I responded “Page 4 of the Town of Lisbon Financial Overview, prepared by Runyon Kersteen Ouellette and briefed during the Town Council meeting on November 5, 2013 the second item under Observations.  It states “The Town’s Unassigned fund balance changed from 2012-2013 as a result of an unfavorable expenditure budget variance.  I am looking for all the Purchase Orders which make up this unfavorable expenditure budget variance.  I hope this is specific enough.”

These are our tax dollars and the people have a right to know how our tax dollars are being spent.  Below is the page taken from the yearly Auditor’s report and as you can see that between 2012 and 2013 the Undesignated Fund Balance dropped $223,514.00.  This unfavorable expenditure reduces the Undesignated Fund to below the recommended balance stated in our Charter.  These funds are to sustain the town in case of emergency from going bankrupt.  




As you can see from the response to FOAA 152, the town is stonewalling.  Apparently, the town does not want the people to know where this $223,514.00 of our tax dollars went to and for what?  I am quite sure it was not used for our roads.  When the Town Council cannot provide an answer to a citizen’s question pertaining to how our tax dollars were spent and the Finance Director either has no clue or does not want to reveal for what this money was spent on then we can be pretty sure it was spent unethically.  Why is it impossible for citizens to know where their tax dollars are being spent especially if the town continues to raise taxes?

As you can see, I have tried all available means to find out about this unfavorable expenditure.  It was important to the Auditors to point this out in their report but it seems to be insignificant to management.  The Town Council, Town Manager and the Finance Director feel the taxpayers have no right to know how their tax dollars are being spent.  It is also clear, that the recommended Undesignated Fund Balance has no meaning to the Town Council, Town Manager or the Finance Director. 

If the taxpayers want someone to explain what this $223, 514.00 of our tax dollars was used for they will have to contact the Town Manager, Stephen Eldridge at seldridge@lisbonme.org or the Finance Director at jmaloy@lisbonme.org .  Taxpayers can call the Town Manager by dialing 353-3000 Ext 102 or the Finance Director by dialing 353-3000 Ext 115.

If anyone finds out what this money was spent on and why, please contact me at this blog site.

Again, I apologize for not being able to provide an answer as to what this money (Unfavorable Expenditure) was spent on!

Council Working Rules‏

                          COUNCIL WORKING RULES

This coming Tuesday night has the possibility of being epic.  Will the new Town Council choose to give the people back their free speech or continue to restrict and censor free speech in the Town of Lisbon?  This council could take a giant step forward in restoring this community back to a great place to raise a family and end all the deceit and the many cover-ups.

The council working rules need to be returned to pre Lori Pomelow rewrite.   The current rules do not allow for residents to bring up any “New Business” during the meeting for other people to see on the Great Falls video review.  It eliminates residents from reviewing crucial aspects of local government.  The council has allotted time prior to the meeting but not all councilors are there and no ideas brought up during this time frame have ever been included in the agenda or the next agenda.  That makes it a total waste of time and is extremely restrictive.

The major reason these Council Working Rules need to be terminated is because residents are forced to speak during Audience Participation without having first heard the Sponsor or the Agenda Item explain the reason for the change and the Councilors debate on the issue.  Prior to Mrs. Pomelow’s rewrite after the Sponsor explained the change and the Councilors debated the issue residents in the audience were allowed to ask questions or provide input.  These current rules force residents to speak without knowing all the facts first. 

The Town’s “Mission Statement” encourages residents to participate in local processes.  The Mission Statement states “We are committed to sharing information with our citizens and including them as partners in the decision making process.”  How can residents become involved in local government if they are not allowed to participate in the process?   If you continue with the current Council Working Rules, the Town’s Mission Statement will have to be rewritten to eliminate the above cited sentence.

Prior to Mrs.  Pomelow's rewrite of the Council Working Rules there were few if any Freedom of Access Acts (FOAA) submitted.  Because of the current Council Working Rules, I believe the town has received over 152 requests.  The FOAA increase is a DIRECT result of these current Council Working Rules.  Since residents have not been allowed to participate in Council meetings in a positive manner, they have had to resort to the only other means available and that is the Freedom of Access Act (FOAA) program.  Local government is suppose to be transparent.  The wheeling and dealing is not part of transparency.  The people have a right to know how their tax dollars are being spent.

This council will have an opportunity to start the healing process for this community by restoring the Council Working Rules back to the Mrs. Pomelow rewrite.  Will they take it?

In case you haven't heard about this guy before, his name will stick in your mind!   The new Maine Governor, Paul LePage is making New Jersey 's Chris Christie look timid. He isn't afraid to say what he thinks. Judging by the comments, every time he opens his mouth, his popularity goes up.
He brought down the house at his inauguration when he shook his fist toward the media box and said, "You're on notice! I've inherited a financially troubled State to run.  Observe...cover what we do...but don't whine if I don't waste time responding to your every whim just for your amusement."
During his campaign for Governor, he was talking to commercial fishermen who are struggling because of federal fisheries rules. They complained that 0bama brought his family to Bar Harbor and Acadia National Park for a long Labor Day holiday and found time to meet with union leaders, but wouldn't talk to the fishermen. LePage replied, "I'd tell him to go to hell and get out of my State."
The Lame Stream Media crucified LePage, but he jumped 6 points in the pre-election poll.
The Martin Luther King incident was a political sandbag, which brought him national exposure. The 'lame stream' media crucified him, but word on the street is very positive. The NAACP specifically asked LePage to spend MLK Day visiting black inmates at the Maine State Prison. He told them that he would meet with ALL inmates, regardless of race, if he were to visit the prison. The NAACP balked and then put out a news release claiming falsely that he refused to participate in any MLK events. He read it in the paper for the 1st time the next morning while being driven to an event and went ballistic because none of the reporters had called him for comment before running the NAACP release.
He arrived at that event & said in front of a TV camera, "If they want to play the race card on me they can kiss my ass", and he reminded them that he has an adopted black son from Jamaica and that he attended the local MLK Breakfast every year that he was mayor of Waterville. (He started his morning there on MLK Day.)
He then stated that there's a right way and a wrong way to meet with the Governor, and he put all special interests on notice that press releases, media leaks, and all demonstrations would prove to be the wrong way. He said any other group, which acted like the NAACP could expect to be at the bottom of the Governor's priority list!
He then did the following, and judging from local radio talk show callers, his popularity increased even more: The State employees union complained because he waited until 3 P.M. before closing State offices and facilities and sending non-emergency personnel home during the last blizzard. The prior Governor would often close offices for the day with just a forecast before the first flakes. (Each time the State closes for snow, it costs the taxpayers about $1 million in wages for no work in return.)  LePage was CEO of the Marden's chain of discount family bargain retail stores before election as governor. He noted that State employees getting off work early could still find lots of retail stores open to shop. So, he put the State employees on notice by announcing: "If Marden's is open, Maine is open!"
He told State employees: "We live in Maine in the winter, for heaven's sake, and should know how to drive in it. Otherwise, apply for a State job in Florida !"   Governor LePage symbolizes what America needs; Refreshing politicians who aren't self-serving and who exhibit common sense.   THE LAW IS THE LAW!

Since we can't pray to God, can't Trust in God and cannot post His Commandments in Government buildings, I don't believe Government (Federal, State and Local) and its employees should participate in Easter and Christmas celebrations which honor the God that our government is eliminating from many facets of American life.               
I'd like my mail delivered on Christmas, Good Friday, Thanksgiving & Easter.  After all, it's just another day.     I'd like the" US Supreme Court to be in session on Christmas, Good Friday, Thanksgiving & Easter as well as Sundays." After all, it's just another day.
I'd like the Senate and the House of Representatives to not have to worry about getting home for the "Christmas Break." After all it's just another day.
I'm thinking a lot of my taxpayer dollars could be saved, if all government offices & services would work on Christmas, Good Friday & Easter. It shouldn't cost any overtime since those would be just like any other day of the week to a government that is trying to be "politically correct."
              
  In fact....I think our government should work on Sundays (AFTER ALL, It was initially set aside for worshiping God....) because, AFTER ALL, our government says that it should be Just ANOTHER DAY...."   
What do you all think????
If this idea gets to enough people, maybe our elected officials will stop giving in to the "minority opinions" and begin, once again, to represent the "majority" of ALL of the American people.

Will The Two New Members To Lisbon's Town Council Do The Right Thing Or Shall It Be More Of The Past?



HERE WE GO AGAIN!!!!

At the last Town Council meeting, the council went into Executive Session under the provisions of 1 M.R.S.A. Statute 405 (6) (E) Consultations with legal counsel regarding Sewer Department fines from DEP.  I fail to understand how the Sewer Department fine from the Department of Environmental Protection (DEP) qualifies as an Executive Session.

On April 16, 2013, the Town Engineer, Ryan Leighton briefed the council and the Public on what took place to warrant the fine of $22,307.00 dollars from the Department of Environmental Protection (DEP).  Attached to the agenda item was the Administrative Consent Agreement issued to the Town of Lisbon.  This matter was clearly discussed in a Public forum and should have been updated in a Public forum and not behind closed doors.

I am sure the town has been in contact with DEP to try and work out a solution.  However, it is important that the people of Lisbon be updated on what is going on with this situation.  Hiding behind closed doors is inappropriate and unethical.  The statute states that “…premature general public knowledge would clearly place the State, municipality or other public agency or person at a substantial disadvantage.”  I do not believe updating the status of this situation and how much the town of Lisbon will have to pay, falls under this statue. 

The town manager determines what qualifies in accordance with Maine Statute 405 for an Executive Session and limited privilege.  Numerous dealings have been conducted behind closed doors and later determined not to have qualified for the Executive Session privilege.  This appears to fall into this category.

The people have a right to know what is going on with this situation and our tax dollars and since it was first brought out in a Public meeting all updates should be provided to the people in a Public forum.   These behind closed door sessions, which are illegal, must stop.  The Town Manager must provide better guidance to the council instead of always leading the council down the wrong path.

I will submit on Monday a Freedom of Access Act (FOAA) for the final decision of the DEP.  Once, I have secured the documents; I will update the community on what is going on.

I hope and pray the new council will restore transparency in local government.
