IT IS TIME FOR THE STATE TO ENFORCE STATE LAWS!



Under the provisions of the “Home Rule” the state cannot interfere with the daily operations of a Municipality.  However, even under the “Home Rule” Municipalities cannot violate or ignore Maine law.  The Town Council has violated Maine Revised Statutes, Title 1:  General, Statute 405 Executive sessions.



According to the latest Agenda, July 21, 2015, Agenda Item 2015-218 Order – 1 MRSA Statute 405 (6)(e) Consultations with legal counsel but did not list the appropriate Agenda Items being discussed such as DEP Consent Agreement; Revaluation Decision or Interlocal Agreement for the Code Enforcement and Stormwater Services.  I understand the need to keep from placing the Municipality at a substantial disadvantage.  No one needs to know the specifics of what is said in Executive Session but the Public has a right to know what is going on in regards to these matters in accordance with Maine Statute 401.

Tuesday night, Chairman Pesce requested a motion to move to Executive Session and it was moved and seconded.  At no time did anyone state why they were moving into an Executive Session except to consult with the attorney.  After approximately 45 minutes, the Council returned and continued on with the meeting.  No Councilor made any motions nor was there a vote taken.  Everyone thought they would tell the people what was going on when it came to the three Agenda Items.



When Agenda Item 2015-210 DEP Consent Agreement and 2015-211 Revaluation Decision came up there was a motion to accept as stated in Executive Session and it was seconded.  Both were approved by a vote of 6-0.  At no time were the people told what is going on or provided a summary of what just took place.  Under Maine Statute the people have a right to know what is going on but they do not have a right to know the specifics of what was said in Executive Session.  The third Agenda Item was tabled.



Maine Statute 405 outlines the procedures to be followed pertaining to Executive Sessions.  This statute was not followed and the people were denied the right to know what is going on with the DEP Consent Agreement and the Revaluation Decision.  

Where is the transparency when the people are denied the right to know what is going on and how their tax dollars are being spent?



Now we are going to look at the Council Working Rules, written by the Council, for the manner in which meeting are supposed to be conducted.   Paragraph d(2) Meeting Length states “All council meetings, workshops, or executive sessions shall be conducted, except in extraordinary circumstances within 2 ½ hours of the time the meeting is called to order.  At regularly scheduled meetings, this will call for adjournment on or before 9:30 P.M.   The council may, by waiving these rules, agree to extend the time for meetings if it is deemed appropriate.  The meeting on July 21st began at 7:30 P.M and was adjourned at approximately 11:30 P.M. and there was no motion to waive the time restriction; Chairman Pesce totally disregarded this provision and continued the meeting.  It was Chairman Pesce’s responsibility, along with the Town Manager, to create the Agenda to be accomplished within the 2 ½ hours time frame.  This was also ignored.  If you look at the Agenda above, you can tell it was too long and needed to be split.



These continued violations of Maine law and the Council’s own working rules need to be stopped immediately. 



The State needs to review the actions of Chairman Pesce and Town Manager, Diane Barnes to ensure that Maine law is being complied with at all times.

Lewiston – Members of the Lewiston-Auburn Rotary Club have invited Lucas Argrew, as their featured guest speaker on Thursday, July 30.   Argrew, owner of Beyond Shoe Repair, is a New England Native. Born in Brockton, which was once the shoe city of Massachusetts, and moved to Portland, Maine as a teenager. Lucas studied many trades and art disciplines until the recession hit in 2008 just after he and his wife had moved to Ohio for grad school. 

When it seemed like everyone was getting laid off and losing money, he took a job with a growing shoe repair company in Columbus. Having such a trade and art heavy background, Lucas settled happily into the industry for five years before deciding to moved back to home to Maine. Realizing that the “Shoe City” of Maine had been void of a cobbler for over a decade, Lucas saw a great opportunity that has proven to be a successful move. Beyond Shoe Repair opened in April of 2014 and has seen nothing but increasing business.

 Open Monday through Thursday from 9 am to 6 pm, they specialize in shoe repairs of all kinds as well as repairs on all sorts of zippers, heavy stitching, leather, and much more.

The Rotary fellowship group meets every Thursday at the Ramada Inn, Lewiston from noon to 1 p.m.  Guests are always welcomed.

Over the past few weeks, there has been significant discussion in the Maine political discourse on whether or not sixty-five bills were vetoed by the Governor or have become law.

Background on Vetoing Legislation
According to clear language in the Maine Constitution, the Governor is allotted ten days to veto legislation while the legislature is in session.
However, if the legislature’s “adjournment” prevents the Governor from returning his vetoes, he may then veto legislation “within 3 days after the next meeting of the same Legislature which enacted the bill or resolution.”

ABUSE OF POWER RUNNING RAMPANT IN LISBON!

Ever wonder how Chairman Pesce can ignore the Charter and Council Working Rules?   

It is very simple because he can.  Who is going to enforce the numerous violations of both the Charter and Council Working Rules?  Chairman Pesce can have the police remove anyone from the council meetings but members of the public cannot ask the police to remove the Chair.  This is called absolute power and violations of this are called abuse of power/position.  But, then again who is going to enforce these violations, no one.

At one point in the history of the town, it was possible to “Recall” a councilor.    However, that ship has sailed many years ago thanks to Michael Bowie and Roger Therriault (former Town Attorney).  These two individuals added additional requirements for Recall to make it harder to approve and easier to reject before it goes to a vote.  The most damaging aspect of the Recall process is that under Part 3 Sec 8-31d (Actions on Petition) is states in this paragraph “An official shall be recalled when a majority of those voting thereon shall have voted in the affirmative so long as the total number of voters who cast votes for and against recall is at least 30% of the total of qualified number voters who cast votes for Governor in the most recent gubernatorial election.”  

 I can remember twice the people tried to recall two different councilors and they failed.  The majority voted in favor of the recall but they did not come close to meeting the requirement for 30%.  In fact, two Priests, a Nun, a Rabbi and the Pope could not get enough voters out to meet this 30% requirement which makes it totally impossible to recall a councilor.

Since, there is no way to recall a councilor and there is no one to enforce the numerous violations by Chairman Pesce; the town’s only course of action is to vote Councilor Pesce out in November.   If he continues his present rate of destroying the community by November, he can do a lot more harm.  I have always supported Councilor Dillon Pesce but he is totally wrong in this vendetta against the School Department.   

This vendetta is causing irreversible damage between the Town Council and the School Department and is costing an enormous amount of taxpayers’ dollars to be used in legal fees.  This money could be better spent on town roads or reducing our taxes.

Councilors Pesce, Bickford and Metivier have got to realize how much damage they are doing to the community and end this vendetta.  Personal character assassinations are cheap low blows that take away from the integrity of the Town Council and each Councilor.  It also reflects poorly on the community because other people are watching Lisbon.

I noticed, at the time of my writing, that the video of the last council meeting is not posted possibly it has technical difficulty.  When the Town is too ashamed of their actions, there are always technical difficulties with the video.

Louisiana Theater Banned Guns Even from Legal Concealed Carry Permit Holders

Once again we see that a mass murder was committed in a so-called “gun free zone.” This time it is Lafayette, Louisiana where a craven murderer opened fire in a place where he knew it was unlikely that anyone would be able to fire back because the theater he went to even banned legal concealed carry permit holders to leave their guns behind.

Last night, July 23, a creep entered the Grand Theater in Lafayette and killed two and wounded seven before he committed suicide. The theater was a “gun free zone.”

Eagle Rising: Elderly Vet Manhandled at Obama VFW Speech!

President Obama travelled to Pittsburgh on Tuesday to speak to several thousand veterans about the ongoing problems in the Department of Veterans Affairs and several other veteran-related issues.
In covering the event, the military news outlet Stars and Stripes notes that it’s not the kind of outlet where the President typically finds a lot of fans.
Perhaps reflecting mixed feelings about the president among veterans, Obama often drew tepid applause, especially for comments about his nuclear deal with Iran. 
While giving his speech, a lone, elderly veteran rose silently and held a sign attacking the Obama administration for their part in the Benghazi debacle (or scandal). Apparently three other veterans don’t believe that silent protest should be allowed at a speech, because they quite literally tackled the older man before ripping his sign away.
Undeterred the man rose again, hands held in the air to protest what he obviously believes to be the grave injustices committed by the Obama administration.
Because he no longer had his sign he was forced to vocalize his displeasure and began yelling Benghazi while the President spoke. This disruption forced security to remove him physically from the building.

A top U.S. Army general with nothing left to lose has publicly admitted something that conservatives have been saying for a long time — the rise of the Islamic State terror group can be directly attributed to President Barack Obama’s premature withdrawal of U.S. military forces from Iraq.
 
Outgoing Army Chief of Staff Gen. Ray Odierno told Fox News on Wednesday that a continued U.S. troop presence in the region would have kept Iraq on a positive track. 
“It’s frustrating to watch it,” Odierno said. “I go back to the work we did in 2007, 2008, 2009 and 2010 and we got it to a place that was really good. Violence was low, the economy was growing, politics looked like it was heading in the right direction.”
“I think it would have been good for us to stay,” he said, adding that he had recommended leaving 30,000-35,000 U.S. personnel in Iraq — a recommendation that Obama, in his rush to keep an ill-considered campaign promise to his base, ignored.
“If we had stayed a little more engaged, I think maybe it might have been prevented,” Odierno told Fox News. “I’ve always believed the United States played the role of honest broker between all the groups and when we pulled ourselves out, we lost that role.”

** BREAKING NEWS** Reuters: Gunman opens fire at Louisiana theater, multiple casualties reported

July 23 (Reuters) - A gunman fatally shot at least one person and injured eight others at a movie theater in Lafayette, Louisiana, before killing himself on Thursday, according to police and local media.
NBC News reported that one person died and eight others were wounded at the Grand Theater in Lafayette before the gunman took his own life.
Those reports could not immediately be confirmed by Reuters, but Lafayette police said in a tweet that they were "working a shooting at the Grand Theater on Johnston Street" and that it involved multiple victims.
The local Advertiser newspaper reported that the gunfire broke out during a 7 p.m. showing of the film "Train Wreck."
Witness Katie Domingue told the paper that the gunman was an older white man who stood up in the theater and began shooting.
"He wasn't saying anything. I didn't hear anybody screaming either," Domingue said.
"Prayers for Lafayette at Grand Theater. Talking to state police colonel about shooting in Lafayette," Louisiana Governor Bobby Jindal said in a tweet.
Lafayette is a city of about 120,000 people roughly 55 miles (90 km) southwest of Baton Rouge. (Reporting by Dan Whitcomb in Los Angeles; Editing by Eric Beech and Ken Wills)
