RECAP TOWN COUNCIL WORKSHOP – SEPTEMBER 3RD

The Town Council held a workshop on September 3, 2015 to discuss several issues.  Councilors Crafts and Garrison were excused.  The following were items discuss:

1.    DRAINAGE ISSUES – There are drainage issues on Frost Hill and two in Wing Street.  The Council talked about whom has liability and responsibility on private property.  This issue has been passed to the town attorney for a legal review.

2.   DAVIS STREET SIDEWALK - According to the Public Works Director, there is approximately 1,450 feet needed to complete the project.  It will cost approximately $15-20 thousand dollars to complete. Work on this project to begin spring or early summer.

3.   ANDROSCOGGIN RIVER TRAIL WASHOUT (LISBON “BIG DIG”) – The Town believes correcting this issue will cost roughly $9,500.00 dollars and the MDOT says the towns solution will not work and that a $27,000.00 dollars solution by MDOT is the only acceptable solution.  I asked if the trail had been accepted by the town and did not get an answer.  The members representing the town did not want to point fingers at who was responsible for this mess.

4.   CHARTER AMENDMENTS – There were only three items brought out at the workshop.  The first was to eliminate the two years term for the Chairman of any and all Committee/Boards to include Town Council and the School Board.  Second it was to raise the limit to borrow money from $100,000 to $250,000 without going to a referendum because the cost of living.  Finally, The Council wants to eliminate the Planning Board from being in the Capital Improvement Plan and at the same time to raise the limit from $10,000 to $25,000.  Also, change the date of submission to the Town from December to May.

 On Fox News’ Sean Hannity show Wednesday evening, the “Great One,” Mark Levin, bemoaned the politicized state of the Justice Department using the failure to properly investigate and pursue Hillary Clinton’s crimes as a prime example of the corruption inherent within the Obama administration.

"Where's the U.S. attorney general? Silent. Not a word. Where's the special prosecutor? Where's Obama's in appointing it? Nowhere. The United States Justice Department, under this president, is in full cover-up mode."

Earlier on the show, correspondent Ed Henry explained to Hannity and his viewers that the Clinton campaign was pushing back against the news that her emails were chock-full of classified information, saying that these revelations were all “to be expected.” While the Clinton team can keep repeating this little distortion, it’s just not so. Much of what has already leaked out has been proven to have been considered classified information when it passed through the Clinton’s personal email server as well.

 As Americans celebrate Labor Day under Hussein Obama According to CNS NEWS record 94,031,000 Americans were not in the American labor force last month — 261,000 more than July — and the labor force participation rate stayed stuck at 62.6 percent, a 38-year low, for a third straight month in August, the Labor Department reported on Friday, as the nation heads into the Labor Day weekend.

The number of Americans not in the labor force has continued to rise, partly because of retiring baby-boomers and fewer workers entering the workforce.

WND reported Welfare Dependency is at an all time High As Barack Obama enters the twilight of his presidency, he presides over an America vastly different from the one he envisioned building during his 2008 campaign that promised to empower everyday Americans on Main Street over wealthy bankers and investors on Wall Street.

THE REAL PROBLEM ISN'T POLICE BRUTALITY

ANOTHER OPINION OF A CONCERNED CITIZEN

There has been a lot of controversy over section  8.11 (the section dealing with “special town meetings”) in our town charter.  Great emphasis has been placed on the word  “any” in that section.   Some feel that School budget  appropriations shouldn’t be included because they are ultimately voted on by the people.  Others feel the one word should be taken literally and it should apply to any appropriation. At the very least this section should be clarified in the near future.

This section is not the only part of Section 8 that needs clarification. In sec. 8.46 it states  If a majority of the qualified voters voting on a budget article at a special Town meeting vote in its favor it shall be considered adopted, IF the total number of votes cast for OR against the budget article is at least 250. 

If we are going to read section 8.11 literally then we should interpret section 8.46 literally also.

   This affirmative majority vote is only valid --IF--  the total number of votes cast for OR against the measure is 250. This very clearly states you need 250 in the affirmative to pass an appropriation. This section doesn't say the sum of yes and no votes must total 250 it says the carrying vote must be 250 votes. The word OR in the sentence means OR not AND.
 I think we should use common sense and not apply sec 8.11 to School Budget Appropriations. I also think that in sec. 8.46 the Charter framers probably meant to say "AND" instead of "OR". 
When we get stuck on one word definitions we can change the whole meaning of the Charter.

EAGLERISING: Hillary Clinton’s Argument for Private Email Server is Literally Unbelievable

NBC’s chief political correspondent, Chuck Todd, appeared on NBC’s Today Show Tuesday morning and made a couple interesting points while discussing the ongoing Hillary Clinton email scandal.

First, Todd notes that the argument that the Clinton campaign has used thus far to fend off criticism for having a private server is actually the worst possible argument they could have offered. Todd brings up a particular email in the recent crop of released emails that shows Clinton’s chief aide Huma Abedin telling Clinton that the State Department IT department didn’t know about her private email account. Todd then uses this example to wonder how in the world it could be MORE convenient to have a private email account when the State Department offers so much more by way of technical support, privacy, security, etc. Basically, the point is this…

SPECIAL TOWN MEETING

This is currently in our Charter.  This further supports the fact that the petition for a Special Town Meeting was sufficient.  This means the Town Council deliberately denied the people the right to be heard in a Special Town meeting.

It is my opinion that the provisions for a Special Town meeting are place in our Charter to resolve difference on budget appropriations.

 Sec 8.11 Special Town Meeting.

(d)The qualified voters of the Town shall have the power to reconsider any budget appropriation at a special Town meeting called by petition. The petition must cite the specific appropriation(s) to be included in the warrant for the special Town meeting.

Please note this provisions state that the voters “have the power to reconsider any budget appropriations at a Special Town meeting.”  The School Budget is a budget appropriation and therefore qualifies for Special Town meeting under the current Charter.  I do not know how anyone can misread this portion of the Charter unless it was a deliberate act by the Town Council to prevent the people from speaking out on this.

Sec. 8.46. - Results of Special Town Meeting.

(a)   Budget Article(s). If a majority of the qualified voters voting on a budget article at a special Town meeting vote in its favor it shall be considered adopted, and shall be treated in all respects in the same manner as budget articles of the same kind adopted by the Council, so long as the total number of votes cast for or against the budget article at the special Town meeting is at least 250. If the special Town meeting does not adopt a budget article(s) as provided herein, the original budget article passed by the Council will immediately take effect.

(b)  [Adoption of budget.] If the budget, or any part thereof, has not been finally adopted on July 1, then the budget for the prior year, or part thereof corresponding with that being challenged, shall remain proportionately in effect.

I do not know how clearer this can be written in our Charter without destroying the purpose of this provision.  The Town Council, minus Councilors Lunt and Garrison, has silenced the people once again.

This inexcusable behavior by certain Councilors needs to be stopped!

RECAP TOWN COUNCIL MEETING – SEPTEMBER 1ST

The following is a recap of the Town Council meeting dated September 1, 2015.  This is a summary of the Council Orders, Resolutions & Ordinances:

1.    Library Brick Work Schedule – Knowles Industrial Service Corporation request that the schedule be move from this year to the spring of next year.  In return, they agreed to a 10% reduction of $4,265.00.  The Council approved this by a vote of 6-0 with Councilor Metivier being excused.

The Public Works Director updated the Council on the Town Office Roof.  Siemens was still gathering information on this project.  No decision was made.

2.    Award Bid for Tax Acquired Property/Write Off – The Council accepted a bid of $250.00 from Louis Wood and wrote off the remaining taxes of $988.95.

3.   FY 15 Homeland Security Grant Application – The Council decided to have the following department apply for their portion of the FY15 Homeland Security Grant for the amount indicated.  For Public Works -$971.82; Police -$4,390.23 and finally Fire - $972.82.

4.   Set Registrar Hours and time to cast absentee Ballots – Registrar Hours are normal hours on September 15, 16, 17, 18, and 21.  For Absentee Hours are 9:00 AM, 10:00 AM, 2:00 PM, 3:00 PM, 4:00 PM, 7:00 PM and 8:00 PM on September 22, 2015.

5.   Thermal Imaging Bid Award – The Council approved the bid to Harrison and Schrader Fire Safety Equipment in the amount of $10,495.00.

6.   Set meeting dates for Charter Amendments – The following dates were approved September 8, 10, 17, October 2 & 26^th and November 3 Election day.

7.   Interlocal Agreement for Code Enforcement – The Council approved the new agreement for Code Enforcement with Sabattus at $22,500.00.

8.   Set Date for School Budget Validation Referendum Election and Order Ballots Printer – The Council voted 4-2 with Councilors Lunt and Garrison voting NO.

9.   Set a Public Hearing for the School Budget Validation Referendum – The Council voted 4-2 with Councilors Lunt and Garrison voting NO.

10.          Appoint Wardens for Election Day September 22, 2015 – The Council voted 4-2 with Councilors Lunt and Garrison voting NO.

11.         Warrant for School Budget Validation Referendum September 22, 2015 -  The Council voted 4-2 with Councilors Lunt and Garrison voting NO.

Under Other Business - The Town Manager discussed Verle Brooks’ sign.  Also, Mr. Karass, Finance Director, provided a presentation about the use of bond proceeds.  It was a lot of double talk so I have no idea of the final decision.  You will need to review the video and make your own decision.  Also, Tracey Steuber provided the Moxie Festival Financial Report. 

Under appointments Shelia Gray was appointed Warden for Ward 1 and Anita Fournier was appointed Warden for Ward 2.

The Chairman announced the Chair of the School Board had requested a meeting of the two groups and it is tentatively scheduled for September 8^th.

A CONCERN CITIZEN'S OPINION!

Our Taxes went Down This Year Thanks to 5 Councilors Refusing to Submit To The Demands of the School's "Special Interest Group"
 

Councilor Pesce and most of the other Councilors are not responsible for the ambiguity of charter section 8-11D.  I am sure that in the future the Councilors will address this confusing section and make the necessary changes to make the section more clear for everyone.

When the Council looks at the budget they see the large picture and represent all of Lisbon's residents.  When the School looks at the budget all they see is how much money they can get for their special interest, the School. 

Today I received my 2015-16 tax bill and thanks to Lisbon Councilors holding the School Department to the same standard they held the town side of the budget, my tax bill went down $200 dollars.  If the School had their way my tax bill would have been as much or more than last years taxes.

I think the Councilors should be commended for the good job they have done this year.  There are more cuts that need to be made but at least our taxes are starting to go down and most of the thanks goes to 5 Councilors that refused to submit to the demands of the Schools "Special Interest Group".

I think anyone that wants to send their tax cut to the school should be allowed to do that. I don't think people should be made to send more and more money to a School Department that returns D's and C's to the residents.

Its time for a little School accountability.

TOWN COUNCIL SCREWS RESIDENTS AGAIN!!!!

Last week, the Town Council declared themselves the approving authority for the School Budget and committed taxes.  This is a complete reversal of the Town Council’s position in June 3, 2015.  In June, the Town refused to declare the people’s initiative petition calling for a Special Town meeting to discuss the correct figure to be placed on the June warrant because the voters had to approve the School Budget first.

In a letter to the Special Town Meeting Petitioner’s Committee (see below), the Town Clerk declared the petition insufficient because the petition was not filed within 15 days after the budget being questioned becomes legally adopted.  If the budget had to be passed by the voters before it can be legally adopted, how can the Town Council declare themselves the approving authority to commit taxes?  Chairman Pesce, it is impossible to have it both ways.

 

I am going to show you have very ignorant the ruling by the town was in June.  Why would you need a Special Town meeting after an election?  The people will already have spoken by their votes.  The provisions in our Charter states, the people can challenge any budget appropriations.  This should mean the School budget be included.  By having the Special Town meeting prior to the election, the people could have determine what figures they were willing to pay and those figures would go on the ballot to be voted on by all the people who wish to vote.

I believe the Charter Commission had the right idea and the people in mind when they placed this section on Special Town meeting in the Charter.  Chairman Pesce and his minions could not take a chance that the people would change their numbers so they denied the people’s right to a Special Town meeting. 

This entire messed created by Chairman Pesce and his minions could easily been avoided had they followed our Charter in the manner it was written.  Think about it, instead of having numerous elections at approximately $3,000.00 per election; a Special Town meeting would hopefully have eliminated the need by having the people provide a number they could live with.  Now as it stands, we have an illegal ruling on the petition and an illegal tax commitment because the people have never approved the School Budget.  In fact, we may need several more elections before we do.

In order to legally correct this mess created by Chairman Pesce, the Town needs to reverse the decision on the Special Town meeting petition and declared the petition sufficient.  The Town Council need to schedule a Special Town meeting and let the people determine what figures they are willing to pay and use those figures for the next election and see if the people will approve the School Budget.  Once the School Budget is approved, use those figures to set the tax commitment.

According to the state, a tax commitment can only be change if it is illegal which this current one is.  Also, the Town has until November 1, to submit our tax commitment to the state.  This allows plenty of time to complete the required action.

The people responsible of this mess is Chairman Pesce, and Councilors Bickford, Metivier, Brunelle and Crafts.  Please thank them when you see them.

P.S.  I want to explain my position on the School Budget.  I believe all budgets are padded to ensure they end up with sufficient funds to continue operating.  All budgets have room for improvement that will not have an adverse effort on their operating capabilities.  In this case, $600,000.00 may look good on paper but in the real world it is not realistic.  However, the methods used by the Town Council were not in an acceptable manner to me.  The total violation of our Town Charter is a prime example.  Also, character assassination is another unacceptable tactic to get your way.  We all have to live and work together in order to move forward.  It is critical that we are civil to each other for the good of the community.

We are becoming accustomed to the liberal way of jurisprudence.  Arrest, convict, release, and repeat.  For some reason, we have lost the idea of punishment.  So, when we hear that a man who has been convicted of repeated sexual assault is caught reentering the country, it should hardly rate as news.  But, it should cause us to ask how we stop this repeat offender.  It seems that the criminal is no longer in fear of justice.

Juan Carlos Alvarez Rodriguez, a criminal alien from Mexico was arrested this week near Alice Texas following a traffic stop by Jim Wells Sheriff’s Office, court records obtained by Breitbart Texas revealed.

We know that all sorts of people enter our country illegally.  It seems only logical that within the constant stream of people, there would be those who have a proclivity for young children.  These people are becoming more and more prevalent in our society; therefore we should not be surprised that they are also becoming more prevalent in Mexican society as well.

Texas is the most free state in the nation. That’s why even during the era of Obama, the Lone Star state has grown and prospered. And they don’t look kindly upon heavy-handed rules from busybody bureaucrats in Washington, D.C.

First Lady Michelle Obama, who was never elected to office, used her position to force lunch control rules on every school in the nation. These programs cost school districts hundreds of millions of tax-payer dollars, because of uneaten lunches. They are low calorie and gross.

Just moments after a news crew was murdered on live television on Wednesday, crazy gun grabbers started foaming at the mouth and chomping at the bit to start spewing their gun control nonsense, politicizing a tragedy before the bodies were even cold.

CNN host Chris Cuomo spoke on the phone with GOP presidential candidate Donald Trump and asked him if, in light of the recent shooting, it’s “time to do something else about guns,” which of course means more laws restricting the Second Amendment or an all out ban.

And the royal family of Jordan doesn’t lack for courage at all.

On Wednesday, a female Islamic world leader made some surprising comments about Islam and ISIS.

The leader, Queen Rania of Jordan, revealed her feelings over how Muslims are combating the Islamic State.

She said via Yahoo! News:

“We are facing a time of great peril. Daesh, or the so-called Islamic State, continues to spread its diabolical ideology,” she said.

GOPDD: McDonald’s Just STUCK IT To Muslims In An EPIC Way

McDonald’s has just teamed up with their fellow fast food chains Pizza Hut and KFC to stick it to Muslims in an epic way.

According to The Political Insider, each of these restaurant chains has rejected the request of an Islamic Imam to have Islam-approved meat served in their establishments.

Mufti Muhammad Arshad, an Imam in Hong Kong, contacted the chains demanding that they use Halal meats, saying it would be a “shrewd business move.” Now, he’s livid that they dared to defy him.

FREEDOMFORCE: Trump Sticks it to Jeb Bush - Not "An Act Of Love" When Illegal Immigrants Rape and Murder

Donald Trump took a jab at the establishment favorite Jeb Bush and his ridiculous stance on amnesty and immigration. Particularly Trump focused on Bush’s comments about illegal immigration being “an act of love.”

Here’s what Bush said:

There should be penalties for breaking the law. But, the way I look at this, and this is not, you know — I’m going to say this and it will be on tape, and so be it. The way I look at this is someone who comes to our country because they couldn’t come legally, they come to our country because their family’s dad who loves their children was worried that their children didn’t have food on the table, and they wanted to make sure their family was intact. And they crossed the border because they had no other means to work to be able to provide for their family.
