Excellent Maine State of the Judiciary Address to Joint Legislature by Chief Justice Saufley‏

Dear Readers:

I've heard Chief Justice Saufley speak before, to a group of other Supreme Court Justices from other states.  She is excellent on detail and concepts.  We are lucky to have her.
Now, note that there is now a bill before the legislature to fund the Judiciary's electronic information system.  We need it, even if it requires a bond, which it will.  An electronic system will increase access to the courts for the little people, like us and, equally important, allow us to easily gather the data that will drive empirical studies and evaluations on Maine's Justice system.  We need those evals because the data so far makes it look like we are treading water on prevention and interventions.

So, read the attached address and let your representatives know that Mainers deserve a modern system of justice.  All of Justice Saufley's previous addresses are on the Court webpages.  

Let's plan on going to her speech next year.

The United States is suffering from a crisis in higher education. Our economy desperately needs highly skilled workers to stay competitive in today’s global economy. But while our existing system of four-year higher education institutions is working well for some highly talented and wealthy students, millions more are graduating without the skills employers want and saddled with tens of thousands in debt.

Collectively, Americans owe more than $1 trillion in student loan debt. That is far more than they owe in credit card or car loan debt. And the youngest Americans owe the most since tuitions have skyrocketed as the amount of federal financial aid for higher education has increased.

Higher debt at an early age means kids moving back in with their parents, cars not bought, marriages not joined, and new homes not built. It is a huge drag on the entire economy.

Something must change.

There are people trying to change higher education. Some of them are even backed by millions in venture capital funding. But, with help from the federal government, the current cartel of higher education providers are shutting them out.

Take Ivy Bridge College, for example, an institution created through a partnership between Tiffin University in Ohio and Altius Education, Inc. Founded in 2008, Ivy Bridge College expanded access to four-year higher ed institutions by first offering traditionally undeserving students a shot at an associate’s degree. By offering extensive support services, including not just tutoring but life-coaching as well, Ivy Bridge established a strong associate’s degree graduation track record, and then, depending on their grades, guaranteed them a transfer to a partnered traditional four-year institution, including household brand names like Arizona State.

Because of its relationship with Tiffin, Ivy Bridge students could pay their tuition with federal loans, which would generate revenue for the university and Altius Education, which financed the company.

Altius and Tiffin worked well together. The Higher Learning Commission, which accredits Tiffin, praised Ivy Bridge in 2010 for “deliver[ing] education to a relatively underserved population,” according to documents obtained by Townhall. By August of 2012, Ivy Bridge had almost 2,200 students. That same year, the Bill and Melinda Gates Foundation awarded the for-profit/non-profit college a Next Generation Learning grant. A year later, HLC told Tiffin that the university must cut ties with Ivy Bridge or risk the loss of its accreditation. Tiffin complied, which has effectively killed Ivy Bridge by cutting it off from federal funding.


“The thing that changed was the political environment that the accreditors were in,” Altius CEO Paul Freedman told Town- hall. And that political environment changed when Higher Learning Commission President Sylvia Manning was hauled before the Senate Education Committee by Chairman Tom Harkin (D-IA) to explain the rise of for-profit colleges such as Kaplan University and the University of Phoenix.

Harkin and his colleagues based their criticism of Manning and HLC on the case of Ashford University, a for-profit institu- tion in Iowa once known as the Franciscan University of the Prairies. With the college on its last legs in 2005, HLC, under the leadership of its previous president, allowed a company called Bridgepoint Education, Inc., to purchase the accred- ited religious school without putting the new for-profit model through an accreditation review.

Six years later, Ashford enrolled 78,000 students receiving more than $600 million in federal subsidies annually. Sixty- three percent of the people seeking four-year bachelor’s degrees dropped out in the first year, according to Harkin, which looks good compared to the 84 percent dropout rate among students pursuing a two-year associate’s degree.

“I think this is a scam, an absolute scam,” Harkin said.

Manning left that hearing having promised that HLC would cut off the shortcut to accreditation (and thus federal dollars) that Bridgepoint had taken. “What happened in 2005 could not happen today,” she said.

When Ivy Bridge College’s for-profit parent company, Altius, tried to operate independently from Tiffin two years later as part of a joint venture, HLC blocked the change and reversed its earlier approval of Tiffin’s relationship with the for-profit institution.

“They’ve boxed the innovators out of higher education,” Freedman told Buzzfeed in an August report on the demise of Ivy Bridge.

Local government services and contracts: Best practices and key issues to watch‏

Municipalities in dire straits are found all over the United States — from Detroit in the north toStockton, Calif., out west, and Central Falls, R.I., in the east, to name just three. While each city’s case is different, the root causes have much in common. They can include the still-lingering impacts of the Great Recession, ongoing deindustrialization, tax limitations, and demographic changes that increase the costs of pensions and health care. Sometimes the causes are spectacular: Jefferson County, Alabama, was hit with debt from an expensive infrastructure upgrade, a corruption scandal, and a drop in revenue. At other times they’re near-silent, including “zombie subdivisions” laid out during the real-estate boom that drain resources and resist solutions.
Even for cities in good financial shape, the current economic climate has increased pressure to trim expenses, keep costs under control and manage complex assets efficiently — expensive projects might once have been limited to roads and sewers, but now can include a 411 system, state-of-the-art hospitals or laptops for public schools.
New ways of funding infrastructure upgrades have been developed, including tax-increment financing, but the benefits are often matched with substantial risks. Public-private partnerships have potential for service delivery, but serious problems can arise if they’re not properly structured and monitored. For example, in 2008 Chicago signed a 75-year lease of its parking meters to a private company for $1.15 billion. The agreement gave the city some much-needed cash, but also could have cost them as much as $1 billion in future revenue, according to the city’s inspector general. The entire deal has been mired in controversy since it was signed.
Covering these issues can be especially challenging for journalists. If your city proposes or announces a new public-private partnership, what’s the best way to judge if the right questions have been asked? If public assets are being sold to a third party or managed by them, is that decision really in the public’s interest? And what happens to issues of equity when all budgeting seems like a zero-sum game?
A 2013 study published in State and Local Government Review“Collaborative Service Delivery: What Every Local Government Manager Should Know,” seeks to provide some of these answers. The authors — Cheryl Hilvert of the nonprofit Center for Management Strategies and David Swindell of Arizona State University’s Center for Urban Innovation — examine a wide range of literature in the field and also analyze the results of a survey of city managers conducted since 1982 by the International City/County Management Association (ICMA).

Ketchikan: The Bush Pilots






Ketchikan: The Bush Pilots chronicles the history of aviation in Southeast Alaska, from the pioneer bush pilots integral to developing the area to today's bush pilots who keep commerce humming and communities connected. Through all the industry booms—mining, fishing, logging, tourism—Ketchikan's bush pilots have been a lifeline, serving as scouts, air taxi drivers, medivacs, and the Pony Express all rolled in to one. Vietnam War peace accords were signed in Paris.

The United States, South Vietnam, Viet Cong, and North Vietnam formally sign "An Agreement Ending the War and Restoring Peace in Vietnam" in Paris. Due to South Vietnam's unwillingness to recognize the Viet Cong's Provisional Revolutionary Government, all references to it were confined to a two-party version of the document signed by North Vietnam and the United States—the South Vietnamese were presented with a separate document that did not make reference to the Viet Cong government. This was part of Saigon's long-time refusal to recognize the Viet Cong as a legitimate participant in the discussions to end the war.
The settlement included a cease-fire throughout Vietnam. It addition, the United States agreed to the withdrawal of all U.S. troops and advisors (totalling about 23,700) and the dismantling of all U.S. bases within 60 days. In return, the North Vietnamese agreed to release all U.S. and other prisoners of war.
Both sides agreed to the withdrawal of all foreign troops from Laos and Cambodia and the prohibition of bases in and troop movements through these countries. It was agreed that the DMZ at the 17th Parallel would remain a provisional dividing line, with eventual reunification of the country "through peaceful means." An international control commission would be established made up of Canadians, Hungarians, Poles, and Indonesians, with 1,160 inspectors to supervise the agreement. According to the agreement, South Vietnamese President Nguyen Van Thieu would continue in office pending elections. Agreeing to "the South Vietnamese People's right to self-determination," the North Vietnamese said they would not initiate military movement across the DMZ and that there would be no use of force to reunify the country.
Footnote: The last U.S. serviceman to die in combat in Vietnam, Lt. Col. William B. Nolde, was killed by an artillery shell at An Loc, 60 miles northwest of Saigon, only 11 hours before the truce went into effect.

A Lesson In History Can Help The 'Discord' Between LePage and Mills; U4ME & Beyond: Public Notice To Maine Governor Paul LePage



Last, Wednesday January 8, 2014, the local news channels addressed the tension between Governor LePage and Attorney General Janet Mills as it relates to the medicaid report, and he said that she could sue him for not releasing the report.
He is a republican, and she is a democrat.
Here is what Governor LePage does not know about.
What happened as a result of the 1855 resolve?
In order to understand what the fraudulent 1855 resolve accomplished, you must understand what the original constitution says and means.
First of all, in the original Constitution of the State of Maine (1820) it states in part in Article V, Part First, Executive Power, Section 8: “He [Governor] shall nominate, and, with the advice and consent of the Council, appoint all judicial officers, the Attorney General (emphasis is mine), the Sheriffs, Coroners, Registers of Probate and Notaries Public……….
This is an Executive Department function ONLY. All of this belongs in this department.
Here is what the 1855 resolve states in part: (View 1855 Resolve, click here.)
“SECT. 10. The land agent and attorney general (emphasis is mine) shall be chosen annually by joint ballot of the senators and representatives in convention.
Vacancies in said offices occurring when the legislature is not in session, may be filled by appointment by the governor, with the advice and consent of the council.”
What is the problem with this resolve?
First of all, the legislative department has NO delegation of authority to “interfere” with another department.
The function of the Attorney General is to “execute” the laws of the state, and that is an Executive department function ONLY.
The legislative department ONLY makes the laws.
“Separation of Powers” is a common law principle among many principles.
