Under the new Marine Corps policy for military facilities in U.S., Marines will NOT be allowed to be armed but will have to “shelter in place.” In other words, “run and hide” in case of attack.

WHERE IS LISBON’S LEADERSHIP


At last night’s Special Town Council workshop with the School Board to discuss the School Budget.  The first think that I found odd was the fact that this was the first meeting of the Town Council and the School Board.  There have been two elections and the amended budget by the Council has been defeated twice because the people thought it was too low.  On September 22, 2015, there yet another election on the School Budget and nothing has changed.  I anticipate the results will be the same.

As the leaders of the town, the Town Council should have been taking the initiative to resolve the differences between the Council and the School Budget.  Councilor Lunt asked Chairman Pesce how the Council arrived at the $600,000.00 mandatory cut for the School Budget.  Councilor Metivier asked Chairman Pesce if he could answer the question.  According to Councilor Metivier, the Municipal budget was forced to cut $300,000.00 and the School Budget is twice as large as the Municipal Budget so the number of $600,000.00 was directed.

Good leaders/managers are aware that before you make significant cuts in any budget, it is essential you know the impact of those cuts.  Just because on paper one budget is twice the size of another the impact will not be the same.  Councilor Metivier has no clue the impact on the $600,000.00 directed cuts.  It was obvious by the questions he asked the School Board.  Councilor Metivier asked why the School Board did not eliminate Adult Education.  First the students pay a portion of the cost and the state subsidizes some of the cost.  Graduates of this program become assets to this community and strengthen our town.  Cutting programs that strengthen our community should never be done because they are the future of Lisbon. 

Another statement made by Councilor Metivier was why are we transporting High School students?  Well, the buses go right by these students daily so why not pick them up if we are going the same way.  Also, the few that are out of the normal routes would not impact the budget a great deal.  This cost savings relieve working parent from having to worry about getting their children to school.  This impact allows working parents to work longer and make money to pay their taxes.

This figure of $600,000.00 was directed by the Council with no idea of the impact to the budget, families or the community.  This has proven to be a mistake that has created a mess.  Leaders/Managers must make decisions with knowledge of the impact to this community.  If the Town Council had utilized good sound management strategy, the town would not be in the current situation.  Had the Council had a clue of the impact prior to the directive, the School Budget would not be sucking $3,000.00 per election of taxpayers’ dollars.    

Another example of wasting money by the Council is when they determined that the people’s petition for a Special Town meeting was insufficient.  Had the petition been approved the Special Town meeting would had resolved the differences between the School Budget submitted by the School Board and the amended figures by the Town Council.  The results of the Special Town meeting could have been placed on the ballet in June and the town could have voted on these figures.  Holding a Special Town meeting after the people vote on amended budget does nothing to resolve the issue and according to Maine law we have to continue the process until the people pass the School Budget.  We are witness to this because we are now on our third election.  If the Town Council had allowed the Special Town meeting prior to the election; the School Budget probably would have passed the first time but it would not have cut $600,000.00.

As it stands right now, the losers here are the students and the taxpayers who have to pay tax dollars for this excess process.

EAGLERISING: Judge Destroys #BlackLivesMatter Lawyer in Open Court!

An obviously overzealous public defender did his worst in an effort to defend his client, but the judge who was forced to listen wasn’t having any of it.

When the lawyer began arguing that his client deserved leniency because of the racist climate in America today, Judge John Hurley jumped in and wrecked the lawyer’s argument.

The first thing judge wanted to note was that the color of the man’s skin was meaningless in the courtroom -- and then he followed with the real issue. The judge noted that the man was caught in a neighborhood he didn’t live in, hiding under the dock of a person he didn’t know and wearing an empty holster just minutes after a police officer had been shot at.

Donald Trump took a jab at the establishment favorite Jeb Bush and his ridiculous stance on amnesty and immigration. Particularly Trump focused on Bush’s comments about illegal immigration being “an act of love.”

Here’s what Bush said:

There should be penalties for breaking the law. But, the way I look at this, and this is not, you know — I’m going to say this and it will be on tape, and so be it. The way I look at this is someone who comes to our country because they couldn’t come legally, they come to our country because their family’s dad who loves their children was worried that their children didn’t have food on the table, and they wanted to make sure their family was intact. And they crossed the border because they had no other means to work to be able to provide for their family.

Ah Huh Don't get Trumped! Eagle Rising:Don’t be Angry at Donald Trump, Be Angry at His Supporters

 I've gone back and forth on this from outright disgust of Donald Trump to guarded support of his candidacy – but at the end of the day, I just don’t get what his supporters see in him.
Let’s just be honest here: Trump was a liberal until very, very recently. Trump is STILL supportive of single payer socialized healthcare (just like Hillary Clinton). Trump believes that the so called “assault weapons” ban should be reinstituted. Trump was pro-choice until he decided to run for President as a Republican in 2011. Trump has argued for HUGE tax increases on the wealthy and he is an economic protectionist – very opposed to “free trade.” In the past he has supported both Bill and Hillary Clinton, as well as many other liberal politicians… the man is not a conservative.
Michael Reagan (the conservative adopted son of former President Ronald Reagan) recently wrote that Donald Trump is a fake conservative and that his candidacy is an embarrassing moment for the GOP, the country and the planet.
Over at the Blaze, Matt Walsh writes that we all know these things. We all know that Trump is no conservative and so Walsh doesn’t blame Trump for what is happening right now in the GOP race for the White House… no, instead, Walsh blames Trump’s supporters.


I suppose it’s no use getting angry at Donald Trump for his repugnant and ridiculous antics. He’s an impetuous phony with no integrity, and he’s just doing what impetuous phonies with no integrity do. It just so happens that he was lucky enough to be born wealthy so he can afford to seek attention by running for president, whereas the typical childish brat is relegated to sitting in the back of the classroom flicking boogers at the girl in front of him. 
That’s all Trump is really doing — political booger flicking (emphasis ours)—  the only difference is that he’s old, rich, and famous, with millions of admirers who proudly insist that a political booger flicker is just what this country needs right now.

DEP Original Agreement with Lisbon‏

 
The Town should publicly disclose the detailed proposal to DEP. The 
public, Conservation Commission, Water Commissioners, ARWC, and 
environmental groups should have had the opportunity to provide input. 
Interested and credible parties with good working relations with DEP 
would have had a real opportunity to enhance the local environment.
 
Other communities around us are getting cash grants from the State of 
Maine for environmental projects. We likely would be awarded a grant if 
the administration was environmentally pro-active and not adversarial 
toward the DEP and local interests.
 
Lisbon has two models for managing our utilities and the results are 
clear. The Water Dept. is overseen by a board, with minutes and open 
public participation. Their public complaints and system operations 
issues are discussed and resolved in the open. The Sewer Dept. does not 
cooperate with the public on any such basis.  The environmental 
contamination by the Lisbon Sewer Dept. is the result of lack of 
visibility and accountability. For instance, there is no disclosure of 
the complaints from the Huston Park area related to the months of sewer 
line back-up or the system failures at the Sabattus River boat launch 
dumping perhaps millions of gallons of raw sewage into the river.
 
This clearly illustrates the need to keep the Water Dept. oversight 
structure. Bringing the Sewer Dept. under the same management would also 
serve the community better than the present system.

ATLANTA — Conservative commentator Erick Erickson on Friday night disinvited GOP presidential candidate Donald Trump from speaking at an activist conference he is hosting here this weekend, citing disparaging remarks Trump made hours earlier on CNN about Fox News Channel anchor Megyn Kelly.
In an interview with The Washington Post, Erickson said Trump had been scheduled to speak at his RedState gathering on Saturday at the College Football Hall of Fame, but he told Corey Lewandowski, Trump’s campaign manager, about an hour before midnight that Trump was no longer welcome.
Trump’s campaign said in a statement that Erickson’s decision was “another example of weakness through being politically correct. For all the people who were looking forward to Mr. Trump coming, we will miss you. Blame Erick Erickson, your weak and pathetic leader. We’ll now be doing another campaign stop at another location.”
Trump’s CNN interview Friday evening instantly drew controversy and criticism after he said Kelly, one of the moderators of Thursday’s Republican presidential debate in Cleveland, “had blood coming out of her eyes, blood coming out of her wherever.”

NYT: Damn These Republicans For Dishonoring Their Commander-in-Chief on the Iran Deal

The tiresome, partisan New York Times editorial board is terribly unhappy with Republicans, which means it's a day ending in 'y.'  This time, they're upset over vigorous, substantive opposition to the Obama administration's nuclear deal with Iran, which they cast as borderline treasonous:

The exaggerations and half-truths that some Republicans are using to derail President Obama‘s important and necessary nuclear deal with Iran are beyond ugly. Invoking the Holocaust, Mike Huckabee, a contender for the Republican presidential nomination, has accused Mr. Obama of marching Israelis “to the door of the oven.” Tom Cotton, a senator from Arkansas, has compared Secretary of State John Kerry, who helped negotiate the deal, to Pontius Pilate. What should be a thoughtful debate has been turned into a vicious battle against Mr. Obama, involving not just the Republicans but Israel’s prime minister, Benjamin Netanyahu. The unseemly spectacle of lawmakers siding with a foreign leader against their own commander in chief has widened an already dangerous breach between two old allies. Policy considerations aside, what is most striking about the demagoguery is how ahistorical, if not downright hypocritical, it is. Negotiating with adversaries to advance a more stable world has long been a necessity, and Republican presidents have been among its most eager practitioners.

The Republican presidential candidate and celebrity plutocrat appeared Monday on The Palin Update, an actual all-Palin radio show that exists on something called Mama Grizzly Radio (we kid you not). 
Host and apparent Palin obsessive Kevin Scholla asked the controversial future president whether he could see himself “picking up the phone, giving the governor [Palin] a call and picking her brain on some things, or perhaps having her along in some official capacity.”
Trump’s response: “I’d love that. Because she really is somebody who knows what’s happening and she’s a special person, she’s really a special person and I think people know that.”

IT IS TIME FOR THE STATE TO ENFORCE STATE LAWS!



Under the provisions of the “Home Rule” the state cannot interfere with the daily operations of a Municipality.  However, even under the “Home Rule” Municipalities cannot violate or ignore Maine law.  The Town Council has violated Maine Revised Statutes, Title 1:  General, Statute 405 Executive sessions.



According to the latest Agenda, July 21, 2015, Agenda Item 2015-218 Order – 1 MRSA Statute 405 (6)(e) Consultations with legal counsel but did not list the appropriate Agenda Items being discussed such as DEP Consent Agreement; Revaluation Decision or Interlocal Agreement for the Code Enforcement and Stormwater Services.  I understand the need to keep from placing the Municipality at a substantial disadvantage.  No one needs to know the specifics of what is said in Executive Session but the Public has a right to know what is going on in regards to these matters in accordance with Maine Statute 401.

Tuesday night, Chairman Pesce requested a motion to move to Executive Session and it was moved and seconded.  At no time did anyone state why they were moving into an Executive Session except to consult with the attorney.  After approximately 45 minutes, the Council returned and continued on with the meeting.  No Councilor made any motions nor was there a vote taken.  Everyone thought they would tell the people what was going on when it came to the three Agenda Items.



When Agenda Item 2015-210 DEP Consent Agreement and 2015-211 Revaluation Decision came up there was a motion to accept as stated in Executive Session and it was seconded.  Both were approved by a vote of 6-0.  At no time were the people told what is going on or provided a summary of what just took place.  Under Maine Statute the people have a right to know what is going on but they do not have a right to know the specifics of what was said in Executive Session.  The third Agenda Item was tabled.



Maine Statute 405 outlines the procedures to be followed pertaining to Executive Sessions.  This statute was not followed and the people were denied the right to know what is going on with the DEP Consent Agreement and the Revaluation Decision.  

Where is the transparency when the people are denied the right to know what is going on and how their tax dollars are being spent?



Now we are going to look at the Council Working Rules, written by the Council, for the manner in which meeting are supposed to be conducted.   Paragraph d(2) Meeting Length states “All council meetings, workshops, or executive sessions shall be conducted, except in extraordinary circumstances within 2 ½ hours of the time the meeting is called to order.  At regularly scheduled meetings, this will call for adjournment on or before 9:30 P.M.   The council may, by waiving these rules, agree to extend the time for meetings if it is deemed appropriate.  The meeting on July 21st began at 7:30 P.M and was adjourned at approximately 11:30 P.M. and there was no motion to waive the time restriction; Chairman Pesce totally disregarded this provision and continued the meeting.  It was Chairman Pesce’s responsibility, along with the Town Manager, to create the Agenda to be accomplished within the 2 ½ hours time frame.  This was also ignored.  If you look at the Agenda above, you can tell it was too long and needed to be split.



These continued violations of Maine law and the Council’s own working rules need to be stopped immediately. 



The State needs to review the actions of Chairman Pesce and Town Manager, Diane Barnes to ensure that Maine law is being complied with at all times.

Over the past few weeks, there has been significant discussion in the Maine political discourse on whether or not sixty-five bills were vetoed by the Governor or have become law.
However, much of this discussion has consisted of personal attacks and false information, and has failed to focus on the legal arguments being made by the Governor, the Maine Legislature, and other political figures.
So what is this veto dispute really about?
Background on Vetoing Legislation
According to clear language in the Maine Constitution, the Governor is allotted ten days to veto legislation while the legislature is in session.
However, if the legislature’s “adjournment” prevents the Governor from returning his vetoes, he may then veto legislation “within 3 days after the next meeting of the same Legislature which enacted the bill or resolution.”
