January 5, 2010 Town Council Meeting‏

Well folks,
 
 I am done with my seasonal, part-time job at LL Bean so, for
what it's worth,  am back attending town Council meetings.

As the meetings no longer seem to be important enough to be published in the
Lewiston Sun Journal, for what it's worth, I will attempt to recap the
Tuesday January 5, 2010 Town Council Meeting.

The meeting was called to order with the Pledge of Allegiance to the Flag of
the United States of America.

Present were Council members Roger Cote, Dale Crafts, Fern Larochelle, Mark
Lunt, Gina Mason, Lori Pomelow, and Chairperson Michael Bowie. A few Town of
Lisbon citizens were also present, in the audience.
The Town Clerk reading of the meeting rules was suspended.

3. PUBLIC HEARING
    There was none

4. CONSENT AGENDA
    2010-1 Order. A. Minutes of the December 1, 2009 meeting was approved on
a 7-0 vote.
 
5. COUNCIL ORDERS, RESOLUTIONS & ORDINANCES
    2010-2 - CMP Street Light Addition for Capital Ave., Littlefield
    Road, and King Road.
A Capital Avenue (Maine Recycling) business has requested a street light for employee parking,
and some Littlefield/King Road citizens requested that a street light be
placed at that intersection. Both requests are for safety reasons.
 

There was considerable discussion as to if we can afford more street lights,
who owns the lights, CMP or the Town. There have been discussions at
previous meets concerning the number of street lights there are in town, are
they all necessary, wattage, the cost of operating said lights. Town Manager
Eldridge said he has a map showing all Town street lights. A copy is
available for Council members. 
 
Councilor Crafts suggested members drive to
Littlefield/King Road after the meeting to see if a light at that
intersection is necessary. Town Manager Eldridge said the Town Engineer and
Chief Brooks will be meeting to discuss if all are necessary and if some can
be eliminated.

This will be tabled until the January 19, 2010 meeting  so they can be
looked into further.

  2010-3 Order - Town Office insulation bids.
Two bids have been received. There is a difference of $400, but one company
is for 6 inches of insulation and the other for 12 inches. There are other
differences, such as areas to be insulated. This also was tabled for further
investigation.

7. AUDIENCE PARTICIPATION
    there was none.

8. APPOINTMENTS
   2010-4 ORDER- Registrar of Voters (1).
   Town Clerk Twila Lycette was appointed for a 2 year term.
    Approved 7-0

   2010-5 ORDER-Voter Registration Appeals Board (1) Lisa Ward (?)
   was appointed. Approved 7-0

   2010-6 ORDER-Appoint Ethics Panel Chairman
   Councilor Bowie made a motion to appoint David Bowie. (No
   relation). Approved 7-0

  2010-7 ORDER-Ethics Panel (1). Chair Councilor Bowie made a
   motion to move Ross Cunningham from alternate to full time. A new
   alternate position will be advertised. Approved 7-0,

  Councilor Cote said the Ethics Panel needs more authority. He feels
  that the Council is not policing itself. He said some previous
  meetings should have been policed and handled a lot better. Council
  Chair Bowie said any changes would have to be done through the
  Town Charter. A very heated discussion followed.

Now, I am not one to just sit back and say nothing. For what it's worth, if
I feel there is something to be said, I speak up. And speak up I did.

Councilor Cote's comments were made in a conversational tone of voice. He
was giving his opinion and offering a suggestion. I can't remember just what
Councilor Bowie's comments were, but his tone of voice was argumentive, as
was Councilor Mason's. This is a topic that warranted discussion, and not
the argument it turned into. I suggested to Councilors Bowie and Mason that
they watch the meeting on TV Thursday evening and see their reactions to
Councilor Cote's comments and suggestions. I wish I had added, that they
watch and listen with an open mind.

I hope the good citizens of the Town of Lisbon watch and decide for
themselves how the Council meetings are conducted; how the Councilors
conduct themselves. The crutch of this discussion was the February 2009
Council meeting when Police Chief Brooks gave an hour and a half tirade
against Councilor Cote. No one has ever been allowed to speak that long. I
have been at Council meetings when Council Chair Bowie said that people were
allowed to speak only twice on a subject and for only five minutes each
time. This is blatant discrimination. And Councilors Bowie and Mason, and
other Councilors who did nothing see nothing wrong in that?
Perhaps Councilor Cote is right. The Ethics Panel is nothing but an Ethics
Panel in name only.

And that is my opinion. I welcome yours.

Well, I have done it!  I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law.  I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying.  The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession..

The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system.  All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals.  Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.

However, as scary as all of that is, it just scratches the surface.  In fact, I have concluded that this legislation really has no intention of providing affordable health care choices.  Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated  If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government.  The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.

The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with!  I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital.  All of this is a protecting against unreasonable searches and seizures.  You can also forget about the right to privacy.  That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you.  It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.

So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law  It doesn't stop there though.

The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;

The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people.  Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea.  This is not about health care; it is about seizing power and limiting rights.  Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation.  If I voted for it anyway, I would hope the American people would hold me accountable.

For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

    The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be In agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows:


    The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it's enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.


    Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it.....


    A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby.


    No one Is bound to obey an unconstitutional law and no courts are bound to enforce it.

Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it.


All citizens and legal residents of the United States, by their presence on the territory of the United States, are subject to the militia duty, the duty of the social compact that creates the society, which requires that each, alone and in concert with others, not only obey the Constitution and constitutional official acts, but help enforce them, if necessary, at the risk of one's life.


Any unconstitutional act of an official will at least be a violation of the oath of that official to execute the duties of his office, and therefore grounds for his removal from office. No official immunity or privileges of rank or position survive the commission of unlawful acts. If it violates the rights of individuals, it is also likely to be a crime, and the militia duty obligates anyone aware of such a violation to investigate it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment from a grand jury, and if one is obtained, prosecute the offender in a court of law.

The elderly parking lot attendant wasn't in a good mood! 

Neither was Sam Bierstock. It was around 1 a.m., and Bierstock, a Delray Beach, Fla. , eye doctor, business consultant, corporate speaker and musician, was bone tired after appearing at an event
He pulled up in his car, and the parking attendant began to speak. "I took two bullets for this country and look what I'm doing," he said bitterly. 

At first, Bierstock didn't know what to say to the World War II veteran. But he rolled down his window and told the man, "Really, from the bottom of my heart, I want to thank you." 
Then the old soldier began to cry. 
"That really got to me," Bierstock says. 




Cut to today. 

Bierstock, 58, and John Melnick, 54, of Pompano Beach - a member of Bierstock's band, Dr. Sam and the Managed Care Band - have written a song inspired by that old soldier in the airport parking lot. The mournful "Before You Go" does more than salute those who fought in WWII. It encourages people to go out of their way to thank the aging warriors before they die. 

"If we had lost that particular war, our whole way of life would have been shot," says Bierstock, who plays harmonica. "The WW II soldiers are now dying at the rate of about 2,000 every day. I thought we needed to thank them." 


The song is striking a chord. Within four days of Bierstock placing it on the Web, the song and accompanying photo essay have bounced around nine countries, producing tears and heartfelt thanks from veterans, their sons and daughters and grandchildren. "It made me cry," wrote one veteran's son. Another sent an e-mail saying that only after his father consumed several glasses of wine would he discuss " the unspeakable horrors" he and other soldiers had witnessed in places such as Anzio, Iwo Jima, Bataan and Omaha Beach. "I can never thank them enough," the son wrote. "Thank you for thinking about them." 

Bierstock and Melnick thought about shipping it off to a professional singer, maybe a Lee Greenwood type, but because time was running out for so many veterans, they decided it was best to release it quickly, for free, on the Web. They've sent the song to Sen. John McCain and others in Washington . Already they have been invited to perform it in Houston for a Veterans Day tribute - this after just a few days on the Web. They hope every veteran in America gets a chance to hear it.

Lisbon - On Friday, December 4th a group of 18 students from the Lisbon High School and Philip W. Sugg Middle School and ten adult Lisbon Volunteers shared Holiday cheer - a gift of Christmas Caroling for the residents at the Lamp Alzheimer’s Facility in Lisbon.  The evening sing-along was such a special time for the residents, as well as for the students and their families.   Upon arrival, student carolers were greeted by a few of the residents, and one resident was so happy to see the students decked out in their Christmas attire, she began to cry.    A special thanks to Richelle Niles, Activity Director at the Lamp Alzheimer’s Facility for inviting students to visit with the residents, and to PWS Music Teacher, Jonathan Pollock, and Lisbon’s Community Resource Coordinator, Monica Millhime, for organizing such a good time for everyone.   The smiles on the residents’ faces made the whole night a blessing to all.

New Year Message From The Govenor Of Maine

AUGUSTA, Maine, Jan. 2 -- Gov. John Baldacci, D-Maine, issued the following text of a radio address:

Good morning. This is Governor John Baldacci.

The Legislature returns to Augusta this week, and there's much work to be done in just a few short months.

My top priority for the Legislative session remains the State budget and the economy.

Through the budget process, which includes extensive review and deliberation by the Legislature, we establish our priorities as a State.

I have put forward my proposal for bringing the State budget into balance, while protecting education, public health and safety, and the economy.

I've used a combination of spending cuts, reorganizations to make government more efficient, and one-time tools to close a budget gap of $438 million dollars.

We have made many tough decisions, and this budget will create hardships. We'll all be called upon to make sacrifices.

But it also protects the people who need our help the most, maintains core government functions and does it without raising taxes, fees or fines.

I know that there are some people who believe higher taxes are the answer to our current budget dilemma. I don't question their motives or their commitment to our State.

But I believe they are wrong.

Working families are struggling under the same global recession that has caused State revenues to fall far short of predictions.

High unemployment and the fear of job loss add to the stress that families already feel.

Uncertainty about the economy leaves many businesses reluctant to invest and to create new jobs.

New taxes will only add to that uncertainty for businesses and create more stress for working families.

I think that's the wrong policy and the wrong message.

Maine needs policies that encourage work and investment, which is why I supported tax reform last year.

That law, which will be on the ballot in June, lowers the State's income tax rates, while making the system more favorable for working men and women.

It also exports about $50 million dollars of Maine's tax burden onto tourists, which means real relief for people who live and work here.

While some folks are advocating that we raise taxes, others are saying that my budget proposal doesn't include enough cuts.

My budget proposal strikes a careful balance between cuts in support for critical government programs, the demand for more efficiency and the use of one-time measures to achieve savings.

I am convinced that we can streamline government more and make it more efficient.

I am proposing additional restructuring within the Natural Resources agencies, Economic and Community Development, the Department of Education, transportation, and health and human services that will save money and improve service delivery.

I know it will work because we've done it before with school district administration reform and our new unified corrections system.

We are saving property taxpayers millions of dollars by eliminating duplication and unnecessary administration in corrections.

No one will accuse this administration of being shy about making touch decisions.

In the last seven years, we have reduced the size of State government by 1,000 positions.

We have held spending flat, while at the same time increasing support for education by $352 million.

And we have kept taxes in check.

For our efforts, the Tax Foundation says Maine's business climate has improved and the Wall Street Journal has touted the Maine Miracle.

But I also know that there are limits to what we can achieve in efficiencies and spending reductions between now and June 30th, which is the end of the fiscal year.

Maine's Constitution requires a balanced budget and the clock is working against us for this year.

While I have proposed significant ongoing savings in my budget proposal, we are also using one-time tools for short-term savings.

Again, it's about finding the right balance.

My proposal is the starting point. Now, the Legislature will have its opportunity to examine my ideas and suggest their own.

At the end of the process, it's my hope that we find a strong, bipartisan solution.

As I look around Maine and the country, I see signs that the economy is beginning to awake.

But nothing is certain, and we must do the hard work now that will position Maine for recovery when it comes.

That is the task we have before us.

Amazing Talent Drawing With Sand

This is just amazing!!
 
 Don't dare to miss this amazing Video Clip . . first read it
 properly.
 
 This video shows the winner of "Ukraine's Got Talent",  Kseniya
 Simonova, 24,  drawing a series of pictures on an illuminated sand table
 showing how ordinary people were affected by the German invasion during
 World War II.  Her talent, which admittedly is a strange one, is
 mesmeric to watch.
 
 The images, projected onto a large screen, moved many in the
 audience to tears and she won the top prize of about £75,000.
 
 She begins by creating a scene showing a couple sitting holding
 hands on a bench under a starry sky, but then warplanes appear and the
 happy scene is obliterated.
 
 It is replaced by a woman's face crying, but then a baby arrives
 and the woman smiles again. Once again war returns and Miss Simonova
 throws the sand into chaos from which a young woman's face appears.
 
 She quickly becomes an old widow, her face wrinkled and sad,
 before the image turns into a monument to an Unknown Soldier.
 
 This outdoor scene becomes framed by a window as if the viewer
 is looking out on the monument from within a house.
 
 In the final scene, a mother and child appear inside and a man
> standing outside, with his hands pressed against the glass, saying
 goodbye.
 
 The Great Patriotic War, as it is called in Ukraine, resulted in
 one in four of the population being killed with eight to 11 million
 deaths out of a population of 42 million.
 
 Kseniya Simonova says:
 "I find it difficult enough to create art using paper and
 pencils or paintbrushes, but using sand and fingers is beyond me. The
 art, especially when the war is used as the subject matter, even brings
 some audience members to tears. And there's surely no bigger
 compliment."

Monmouth Police Chief Resigns, If Lisbon Could Only Be This Lucky

"MONMOUTH -- The embattled chief of the town's Police Department has resigned. In a resignation letter delivered to selectmen during Wednesday's regular board meeting, Police Chief Robert Annese said his decision was prompted by family, particularly his wife, Debra Annese.
"This has been a twenty-four hour a day job for three-and-a- half years," Robert Annese wrote. "The accumulative effect of all of this has caused stress on my wife and family and is beginning to affect our marriage. Debbie has asked me to resign my position, and I am going to comply with her request.""

How About The Issue of Passport?

While I've little interest in getting in the middle of the Obama birth issue, Paul Hollrah over at FSM did so  yesterday and believes the issue can be resolved by Obama answering one simple question: What passport did he use when he was shuttling between New York , Jakarta , and Karachi ?
So how did a young man who arrived in New York in early June 1981, without the price of a hotel room in his pocket,suddenly come up with the price of a round-the-world trip just a month later?

 And once he was on a plane, shuttling between New York , Jakarta , and Karachi , what passport was he offering when he passed through Customs and Immigration?

 The American people not only deserve to have answers to these questions, they must have answers. It makes the debate over Obama's citizenship a rather short and simple one.
 Q: Did he travel to Pakistan in 1981, at age 20?
 A : Yes, by his own admission.
 Q: What passport did he travel under?
 A: There are only three possibilities.
              1) He traveled with a U.S.. Passport,
              2) He traveled with a  British passport, or
              3) He traveled with an Indonesia passport.

 Q: Is it possible that Obama traveled with a U.S. Passport in 1981?
 A: No.. It is not possible. Pakistan was on the U.S. State Department's "no travel" list in 1981.
 Conclusion: When Obama went to Pakistan in 1981 he was traveling either with a British passport or an Indonesian passport.
If he were traveling with a British passport that would provide proof that he was born in Kenya on August 4, 1961, not in Hawaii as he claims. And if he were traveling with an Indonesian passport that would tend to prove that he  relinquished whatever previous citizenship he held, British  or American, prior to being adopted by his Indonesian step-father in 1967.
 Whatever the truth of the matter, the American people need to know how he managed to become a "naturalborn" American citizen between 1981 and 2008..
 Given the destructive nature of his plans for America, as illustrated by his speech before Congress and the disastrous spending plan he has presented to Congress,the sooner we learn the truth of all this, the better.


 If you Don't care that Your President is not a  natural born Citizen and in Violation of the Constitution, then Delete this and go into your cocoon.

VERY QUIETLY OBAMA'S CITIZENSHIP CASE REACHES THE SUPREME COURT

AP- WASHINGTON D.C. - In a move certain to fuel the debate over Obama's qualifications for the presidency,the group "Americans for Freedom of Information" has Released copies of President Obama's college transcripts from Occidental College . Released today, the transcript school indicates that Obama, under the name Barry Soetoro, received financial aid as a foreign student from Indonesia as an undergraduate at the The transcript was released by Occidental College in compliance with a court order in a suit brought by the group in the Superior Court of California.


 The transcript shows that Obama (Soetoro) applied for financial aid and was awarded a fellowship forforeign students from the Fulbright Foundation Scholarship program. To qualify, for the scholarship, a student  must claim foreign citizenship.


This document would seem to provide the smoking gun that many of Obama's detractors have been seeking. Along with the evidence that he was first born in Kenya and there is no record of him ever applying for US citizenship, this is looking pretty grim. The news has created a firestorm at the White House as the release casts increasing doubt about Obama's legitimacy and qualification to serve as President article titled, "Obama Eligibility Questioned," leading some to speculate that the story may overshadow economic issues on Obama's first official visit to the   U.K. In a related matter, under growing pressure from several groups,


Justice Antonin Scalia announced that the Supreme Court agreed on Tuesday to hear arguments concerning Obama's legal eligibility to serve as President in a case brought by Leo Donofrio of New Jersey . This lawsuit claims Obama's dual citizenship disqualified him from serving as president. Donofrio's case is just one of 18 suits brought by citizens demanding proof of Obama's citizenship or qualification to serve as president.


Gary Kreep of the United States Justice Foundation has released the results of their investigation of Obama's campaign spending. This study estimates that Obama has spent upwards of $950,000 in campaign funds in the past year with eleven law firms in 12 states for legal resources to block disclosure of any of his personal records. Mr. Kreep indicated that the investigation is still ongoing but that the final report will be provided to the U.S. attorney general, Eric Holder. Mr. Holder has refused to comment on the matter. HUMAN EVENTS PETITION TO FREE THE SEALs

Dear Secretary Gates:

We, the editors and staff of HUMAN EVENTS, and the many Americans who have attached their signatures to this petition, hereby request your personal intervention to dismiss the charges against Navy SEAL operators SO2 Jonathan Keefe, SO1 Julio Huertas and SO2 Matthew McCabe.

These three men are charged with abusing a terrorist they captured in a daring nighttime raid on or about 1 September 2009. On that night, they -- as part of a platoon from SEAL Team 10 -- captured and detained Ahmed Hashim Abed, one of the most barbaric and dangerous terrorists in Iraq. The terrorist -- in a move that is literally right out of the al-Queda training manual -- complained of abuse, apparently alleging he was struck in the stomach.

We had hoped that the SEALs’ commanders would dispose of this matter at the lowest level -- with a scolding and perhaps a few hundred pushups -- for anyone actually guilty of inflicting an inconvenience on this bloody-handed barbarian. But on 29 September 2009, Gen. David H. Petraeus signed a letter authorizing MGen. Charles T. Cleveland to dispose of the allegations of misconduct. In that letter, Gen. Petraeus said that MGen. Cleveland could, "...dispose of these matters in any manner you deem appropriate. This includes the authority to convene courts-martial at any level up to and including General Courts-Martial and to refer charges concerning these individuals to any court-martial."

The three now face special courts-martial next month. We believe their commanders -- including General Petraeus -- have failed you, the SEALs and the American people by not preventing the matter from going this far.

You are the person next in line above General Petraeus in the chain of command. You can, legally under the Uniform Code of Military Justice, intervene to dismiss the charges against the three SEALs and direct that they be restored to duty.

We respectfully request that you do so forthwith. For this matter to continue -- and to place the honor and fighting future of these three men at stake -- is manifestly a gross injustice.
