States Gov. LePage “In choosing judges, my focus is on the qualifications, demeanor, and integrity of the candidates, not politics.”

 William Schneider does not possess the qualifications, integrity, ethics, honesty nor trustworthiness of a judgeship.

As former Attorney General, he failed in his duties and obligations as Maine’s top law enforcement officer. His Obstruction of Justice, malicious prosecutions and selective prosecutions have interfered with justice and the rule of law. As he was unable/refused to perform his duties and obligations as Attorney General, his lack of respect for law and justice and his lack of honor in a position of public trust will not enhance public confidence in the legal system with Mr. Schneider on the bench.  

Additionally, this is contrary to the precepts upon which the Maine Code of Judicial Conduct is founded.
Mr. Schneider will carry his bias, prejudicial and selective “web of deceit” into the courtroom.

This nomination/confirmation must be opposed.

ABC news reports “Federal officials say they have taken down the largest Medicare fraud scheme investigators have ever discovered: a $375 million dollar home healthcare scam operating in the Dallas, Texas area.

The alleged “mastermind” of the fraud, Dr. Jacques Roy, is charged with certifying hundreds of fraudulent claims for Medicare reimbursement, and pocketing millions in payments for services not needed, or never delivered.
According to the indictment, Dr. Roy and his co-conspirators, for years, ran a well-oiled fraudulent enterprise in the Dallas area, making millions by recruiting thousands of patients for unnecessary services, and billing Medicare for those services.

He allegedly hid much of his Medicare money in an offshore account in the Cayman Islands.”

It’s time for an investigation into the state of Maine.
Repeated requests were made for a full investigation into Medicare/Medicaid payments that were paid out in excess for prescription drugs that were not needed, medical equipment that was not needed and stays (against the will of a person) at a local hospital and nursing home in Biddeford.  This has been brushed under the rug. The Maine Bureau of Corporations did not have any filing in the name of the nursing home. It was discovered through the Medicaid printout that North Country Health Care Assoc. received Medicaid payments for the nursing home in 1998 and their license was cancelled in the 1980′s.

An investigation is warranted into monies given to a corporation that was not licensed at the time of receipt of Medicaid funding , North Country Health Care Assoc.

Audio of an internal VA meeting obtained by TheDC confirms that VA officials in Los Angeles intentionally canceled backlogged patient exam requests.”

A Lesson In History Can Help The 'Discord' Between LePage and Mills; U4ME & Beyond: Public Notice To Maine Governor Paul LePage

“Last, Wednesday January 8, 2014, the local news channels addressed the tension between Governor LePage and Attorney General Janet Mills as it relates to the medicaid report, and he said that she could sue him for not releasing the report.

He is a republican, and she is a democrat.

Here is what Governor LePage does not know about.

What happened as a result of the 1855 resolve?

In order to understand what the fraudulent 1855 resolve accomplished, you must understand what the original constitution says and means.

First of all, in the original Constitution of the State of Maine (1820) it states in part in Article V, Part First, Executive Power, Section 8: “He [Governor] shall nominate, and, with the advice and consent of the Council, appoint all judicial officers, the Attorney General (emphasis is mine), the Sheriffs, Coroners, Registers of Probate and Notaries Public……….”

This is an Executive Department function ONLY. All of this belongs in this department.

Here is what the 1855 resolve states in part: (View 1855 Resolve, click here.)

“SECT. 10. The land agent and attorney general (emphasis is mine) shall be chosen annually by joint ballot of the senators and representatives in convention.

Vacancies in said offices occurring when the legislature is not in session, may be filled by appointment by the governor, with the advice and consent of the council.”

What is the problem with this resolve?

First of all, the legislative department has NO delegation of authority to “interfere” with another department.

The function of the Attorney General is to “execute” the laws of the state, and that is an Executive department function ONLY.

The legislative department ONLY makes the laws.

“Separation of Powers” is a common law principle among many principles.

Public Hearing on Proposed Rules
January 31, 2014 – 11:00 a.m. to 12:15 p.m. – MSBA Annual Meeting – Mariott at Sable Oakes

The Board of Overseers of the Bar will hold a public hearing to receive testimony on the proposed rewrite of the Maine Bar Rules.  In 2011, the Board established a committee to undertake a complete review of the administrative and disciplinary rules contained within the Maine Bar Rules. After two years of work, the committee has proposed new rules integrating many of the current Maine Bar Rules and Board Regulations, as well as aspects of the ABA Model Rules for Lawyer Disciplinary Enforcement.  The public hearing will provide attendees with an opportunity to comment on the proposed rules before submission to the Supreme Judicial Court.  Members of the bar are encouraged to submit written comments in advance of the hearing.  Those who will be testifying and/or submitting written materials should contact the Board’s Executive Director, Jacqueline Rogers.  Download proposed rules.
